The case of Berghuis v. Thompkins, 560 U.S. 370 (2010), is a landmark decision case by the United States Supreme Court in which the court did take into consideration the location of the suspect which appreciates the parties individual rights to remain quiet under Miranda v. Arizona and are conscious of the fact that they have the right to maintain silence even though would not explicitly invoke or relinquish upon the rights.
